These Terms & Conditions ("Terms") govern your access to and use of our websites (the "Website"), and Platforms (together, the "Platform", and together with the Website, the "Services"), operated by NZmark Pte. Ltd. (UEN 202411974C), a company incorporated in Singapore ("NZmark", "Healthy Tec", "we", "us", "our").

By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. About the Services

Healthy Tec provides a wellness and engagement platform of cognitive and physical activities for seniors, together with tools for their paired family members, friends and caregivers, delivered in partnership with Active Ageing Centres ("AACs") and other community partners ("Partners"). The Services are wellness and engagement tools only — see Clause 12 (Clinical Disclaimer).

2. Eligibility

2.1 The Platform is available to: (a) seniors aged 60 and above enrolled through a partner AAC and assessed by that AAC as low-to-medium cognitive risk ("Seniors"); and (b) one paired "Dyad" partner per Senior — a family member, friend or caregiver aged 18 or above ("Dyad Partners").

2.2 All cognitive risk classification, escalation and referral is performed solely by the partner AAC under its own protocols. NZmark relies on the AAC's classification and does not itself perform capacity or risk assessments. Individuals assessed as high risk are not eligible and will be referred by the AAC to appropriate clinical services.

2.3 The public pages of the Website may be browsed by anyone; account registration on the Platform is subject to Clause 2.1.

3. Accounts

3.1 Accounts are personal and non-transferable. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorised use at Team@Healthy-tec.com.

3.2 You warrant that the information you provide at registration is true, accurate and current, and you will keep it updated.

4. Dyad Consent

A Dyad Partner must create their own account and consent to the processing of their own personal data. A Senior's progress is shared with the linked Dyad Partner only with the Senior's consent, which may be withdrawn at any time via Account Settings or by emailing Team@Healthy-tec.com.

5. Crystals and Vouchers

5.1 "Crystals" are a non-monetary engagement unit with no cash value. Crystals: (a) are earned only through legitimate participation and gameplay; (b) are redeemable for vouchers at our events, subject to availability; (c) are non-transferable; (d) expire at the end of each programme cycle; and (e) are not exchangeable for cash.

5.2 We may adjust or forfeit Crystal balances obtained through breach of these Terms (see Clause 10).

6. Lucky Draw

Participation in any lucky draw is free and requires no purchase. Entries are earned only through programme participation. The draw is a goodwill engagement activity and is not conducted as a game of chance under the Gambling Control Act 2022. NZmark's decision on draw outcomes is final. NZmark employees and their immediate family members are excluded.

7. Merchant Offers

Offers from merchant partners are subject to the merchant's own terms. NZmark facilitates promotion only and is not responsible for the honour, quality or fulfilment of merchant offers.

8. Programme Observation and Insights

8.1 What we do. To improve the Services and develop new activities and content that better serve Seniors and caregivers, authorised NZmark personnel may access and observe engagements conducted on or through the Platform, and may attend and observe programme sessions, workshops and activities held with our Partners (together, "Engagement Observation"). This includes reviewing how activities are used, participation and interaction patterns, feedback, and facilitator and volunteer interactions.

8.2 Purpose limitation. Engagement Observation is carried out solely to: (a) understand how participants engage with activities; (b) identify usability and accessibility improvements; (c) inform the design and development of new games, activities and content; and (d) support the training of facilitators and volunteers. Insights derived from Engagement Observation are recorded in de-identified or aggregated form wherever practicable.

8.3 What we do not do. Engagement Observation is not clinical monitoring. Consistent with Clause 12, NZmark does not observe, assess or draw inferences about any individual's cognitive health, and no individual clinical conclusions are generated or recorded through Engagement Observation.

8.4 In-person sessions. Where Engagement Observation takes place at a Partner's premises or events, it is conducted with the knowledge and agreement of the Partner and in accordance with our Privacy Policy and the applicable data processing arrangements with that Partner.

8.5 Safeguards. Access to Engagement Observation records is restricted to authorised personnel on a need-to-know basis, and such records are handled in accordance with our Privacy Policy, including the security, retention and access provisions therein.

9. Success Stories, Publicity and Educational Use

9.1 De-identified case studies. NZmark may describe programme outcomes, pilot results and success examples in aggregated and de-identified form (for example, statistics, anonymised quotes, and case studies that do not identify any individual) in its publications, website, presentations, grant and funder reports, and educational and training materials.

9.2 Identified stories — consent required. Where a success story, testimonial, photograph, video or other material would identify a Senior, Dyad Partner, volunteer or Partner staff member, NZmark will use it for publicity or educational purposes only with the express written consent of that individual (or, where the individual lacks capacity to consent, of a person lawfully authorised to consent on their behalf), given through a media/publicity release form that describes the intended uses.

9.3 Withdrawal. Consent under Clause 9.2 may be withdrawn at any time by emailing PDPA@Healthy-tec.com. Withdrawal takes effect prospectively: we will cease new uses within a reasonable period, but materials already published, printed or distributed before withdrawal may remain in circulation.

9.4 Partner approvals. Use of a Partner's name, logo or programme results in publicity is subject to any approval requirements in our agreement with that Partner.

10. Fair Play and Acceptable Use

You must not: (a) use bots, scripts or automation; (b) manipulate leaderboards or Crystal balances; (c) share accounts; (d) interfere with or disrupt the Services or their security features; (e) reverse engineer or copy the Platform; or (f) use the Services for any unlawful purpose. Breach may result in forfeiture of Crystals, suspension or termination.

11. Leaderboards

Your display name appears by default on in-game leaderboards and may be announced at AAC ceremonies. You may opt out at any time via Account Settings or by emailing Team@Healthy-tec.com, without affecting your Crystal or voucher eligibility.

12. Clinical Disclaimer

12.1 The Services are wellness and engagement tools. They are not medical devices and not diagnostic instruments, and they do not provide medical advice, diagnosis, screening, assessment or treatment.

12.2 Gameplay scores, rankings and Crystal balances indicate engagement only. They do not diagnose, screen for or indicate dementia, mild cognitive impairment or any other condition, and no inference about cognitive health should be drawn from them or from any change in them.

12.3 NZmark does not monitor gameplay or Engagement Observation records for clinical indicators and owes no duty to detect, flag or escalate any health condition. Users, caregivers and third parties must not rely on the Platform — or the absence of any alert — as an indicator of health. Concerns should be raised with a doctor or your AAC. In a medical emergency, call 995 or go to the nearest hospital.

12.4 To the maximum extent permitted by law, NZmark accepts no liability for any act, omission, delay, misclassification or failure by any AAC, healthcare provider, caregiver or other third party, or for any outcome arising from any referral chain.

13. Intellectual Property

The Services, the Crystal Games, and all associated branding, software, text, graphics, audio and content are owned by or licensed to NZmark and protected by intellectual property laws. Third-party components are used under valid licence. You receive a limited, personal, non-commercial, revocable licence to use the Services in accordance with these Terms. No other rights are granted.

14. No Warranty

The Services are provided "as is" and "as available". To the extent permitted by law, we do not warrant that the Services will be uninterrupted, error-free or fully secure.

15. Limitation of Liability

15.1 To the maximum extent permitted by law: (a) NZmark's total aggregate liability arising out of or in connection with the Services is capped at the fees (if any) paid by you to NZmark in the 12 months preceding the claim; and (b) NZmark excludes liability for indirect, consequential, incidental, special and punitive loss.

15.2 Nothing in these Terms limits or excludes: (a) liability for death or personal injury caused by our negligence; (b) liability for fraud or fraudulent misrepresentation; (c) your rights under the Consumer Protection (Fair Trading) Act 2003 and other applicable Singapore law; or (d) any liability that cannot lawfully be limited or excluded. The rights of elderly consumers under the CPFTA are expressly preserved.

16. Suspension and Termination

We may suspend or terminate your access for breach of these Terms or on completion of the applicable programme cycle. You may close your account at any time by emailing Team@Healthy-tec.com. Clauses 8.5, 9, 12, 13, 15, 17 and 18 survive termination.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified on the Platform and, where practicable, by email, with reasonable advance notice. Your continued use of the Services after the effective date constitutes acceptance. If you do not agree to a change, you may close your account before it takes effect.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising out of or in connection with them.

19. General

If any provision of these Terms is held invalid, the remainder continues in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any programme-specific rules notified to you, form the entire agreement between you and NZmark regarding the Services.

To the fullest extent permitted by law, RLClub and its affiliates, officers, employees, agents, partners, and licensors will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.


Governing Law


These terms and conditions will be governed by and construed in accordance with the laws of the jurisdiction in which RLClub operates, without giving effect to any choice of law or conflict of law provisions.


Changes to Terms


We reserve the right to modify these terms and conditions at any time, so please review them periodically. Your continued use of our services after we make changes constitutes your acceptance of the changes.
